Privacy Policy of Storware

Thanks for using Storware website and products! This Privacy Policy covers your use and access to the services provided by Storware via Websites i.e., offering and selling of software produced by Storware (Storware Backup and Recovery, vProtect, Kodo for Cloud, Kodo for Endpoints), technical assistance for Users, sending newsletters and marketing information about Storware and its software (“Services”). Our Privacy Policy explains how we collect and use data and personal information about users who use or apply for Storware Services or visits any of our Websites. By using our Services, you agree to be bound by these terms. If you’re using our Services for an organization, you agree to this Privacy Policy on behalf of that organization. Therefore, before you start using our Services, please read this Privacy Policy in full to ensure you are fully informed. The Data Administrator determines the purposes and means of the Processing of Personal Data.

GDPR (General Data Protection Regulation)

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

Personal Data (or Data)

Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing

Any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

User

Means any natural person who uses or apply for Services or visits any of our Websites, to whom the Personal Data refer.

Storware processes personal information in accordance with GDPR and other data protection regulations applicable to Storware.

Due to the Internet’s rapidly evolving nature, Storware may need to update this Privacy Policy from time to time. If we change how we collect or use your personally identifiable information, Storware will post a prominent change notice with its updated Privacy Policy on our Websites. We will send registered Users to notice of the change before the change becoming effective. Storware encourages you to review this Privacy Policy regularly so that you are aware of what personally identifiable information we may collect and how we may use this information. Your continued use of the Website and/or continued provision of personally identifiable information to us will be subject to the terms of the then-current Privacy Policy.

Types of data collected When you use our Services, you provide us with things like your files, content, e-mail messages, contacts, and so on. The terms of the Privacy Policy don’t give us any rights to your Personal Data except for the limited rights that enable us to provide the Services.

We need your permission to do things like hosting your Personal Data, backing it up, and sharing it when you ask us to. Our Services also provide you with features like photo thumbnails, document previews, e-mail organization, easy sorting, editing, sharing, and searching. These and other features may require our systems to access the store and scan your Personal Data.

• e-mail address
• country
• other information is given in the Contact Form or the e-mail.

In this case, the purposes of the Processing of the Personal Data, as well as the legal basis for the Processing, is the performance of a contract to which the User is a party or to take steps at the request of the User to entering into a contract (Article 6 b) GDPR).

Through the License Registration Form at www.storware.eu/licenses Storware collect the Personal Data as follows:

• first name and last name
• email address
• phone number
• your company name and role
• city and country
• home address

In this case, the purposes of the Processing of the Personal Data, as well as the legal basis for the Processing, is the performance of a contract to which the User is a party or to take steps at the request of the User to entering into a contract (Article 6 b) GDPR). Also, in this case, Processing is necessary for compliance with a legal obligation to which the Administrator is subject (Article 6 c) GDPR.

The Processing of Personal Data to the marketing purposes and to receive Newsletter takes place only after the User’s consent (article 6 a) GDPR).

Storware Process your Personal Data only if Processing is necessary for the performance of the Services or to take steps at your request before entering into the Services, such as:

• making the Services available to you;
• administer the Services;
• deal with your inquiries and requests (for example, if you were to contact customer services to ask for help and assistance, then we would need to process your contact details).

Mode of processing the data

The Data Administrator Processes the Personal Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Personal Data.

The Personal Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Data

Administrator, in some cases, the Personal Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, clouds provides IT companies, communications agencies) appointed, if necessary, as Data Processors by the Data Administrator. The updated list of these parties may be requested from the Data Administrator at any time.

Storware does not have to transfer Personal Data to a third country or international organization.

Storware does not use your Personal Data for automated decision-making, including profiling.

Retention time

The Personal Data is Process for the time necessary to provide the Services requested by the User, or stated by the purposes outlined in this document. Storware will delete the Personal Data after that time except where we need to keep any personal information to comply with our legal obligations, resolve disputes, or enforce our agreements.

Any person who has consented to the Processing of Personal Data to the marketing purposes and to receive Newsletter has the right to withdraw consent at any time, without affecting the lawfulness of Processing based on consent before its withdrawal.

Recipients of the Personal Data

Recipients of the Personal Data are companies that provide technical services for Storware.

Legal action

The User’s Personal Data may be used for legal purposes by the Data Administrator, in Court, or the stages leading to possible legal action arising from improper use of the Services. The User declares to be aware that the Data Administrator may be required to reveal personal data upon request of public authorities.

The rights of Users

Users have the right to request from the Data Administrator access to and rectification or erasure of Personal Data or restriction of Processing concerning them or to object to Processing as well as the right to data portability.

Users have the right to lodge a complaint with a supervisory authority.

Cookies

Services do not automatically gather any information, except for the information contained in cookies (“Cookies”). Cookies are files that are stored on your computer or other devices on which you visit the Websites. They are created when you visit the Websites.

They include the name of the Website from which they originate, their retention time on a terminal device, and a unique number.

Storware uses Cookies for:
